These Terms of Service ("Terms") govern your access to and use of the Quimbel platform available at https://www.quimbel.app.

Quimbel is a software platform that enables freelancers and businesses to create invoices, track payments, and manage client billing information.

By accessing or using Quimbel, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.


1. Definitions

Service
The Quimbel platform, website, software, and related services.

User
Any individual or organization accessing or using the Service.

Content
Any information, data, invoices, client details, or materials uploaded or created by users through the Service.

Subscription
A paid plan that provides access to additional features of the Service.


2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service.

By using Quimbel, you represent that you meet these requirements.


3. Account Registration

To access certain features, you must create an account.

You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Be responsible for all activity occurring under your account

Quimbel is not responsible for losses caused by unauthorized account access resulting from your failure to secure your credentials.


4. Description of Service

Quimbel provides a cloud-based invoicing and payment tracking platform designed for freelancers and small businesses.

The Service allows users to:

  • Create and send invoices
  • Track paid, pending, and overdue payments
  • Manage client records
  • Export invoice data
  • Monitor billing activity through a dashboard

Quimbel does not provide accounting, financial, tax, or legal advice.

Users remain responsible for ensuring that their invoices and financial records comply with applicable laws and tax regulations.


5. Subscription Plans

Quimbel may offer multiple subscription plans, including:

  • Free Plan
  • Pro Plan
  • Business Plan

Each plan may include different features and limitations.

Quimbel reserves the right to modify plan pricing, features, or limitations at any time with reasonable notice.


6. Billing and Payments

Paid subscriptions are billed on a recurring basis, typically monthly or annually depending on the plan selected.

By purchasing a subscription you agree to:

  • Provide valid payment information
  • Authorize recurring billing
  • Pay all applicable subscription fees and taxes

Failure to successfully process payment may result in suspension or termination of your account or access to premium features.


7. Payment Processing (Stripe)

Payments for Quimbel subscriptions are processed through third-party payment processors such as Stripe.

By purchasing a subscription you agree to:

  • Stripe's terms and policies
  • Secure handling of payment data through Stripe

Quimbel does not store full credit card information on its servers.

All payment information is handled by the payment processor in accordance with industry security standards.


8. Subscription Renewal

Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.

The renewal will be charged using the payment method on file.


9. Cancellation

You may cancel your subscription at any time through your account settings.

After cancellation:

  • Your subscription remains active until the end of the current billing cycle
  • No further charges will occur

Downgrading to the Free plan may disable certain premium features.


10. Refunds

Refunds may be issued in cases such as:

  • Duplicate billing
  • Technical failure preventing service access
  • Billing errors

Refund requests must typically be submitted within 7 days of the charge date.

Failure to cancel before renewal may not qualify for a refund.


11. Chargebacks

If a user initiates a chargeback without first contacting Quimbel support to resolve a billing dispute, Quimbel reserves the right to:

  • Suspend the associated account
  • Terminate access to the Service

Users should contact support@quimbel.app before initiating any payment dispute.


12. Acceptable Use

You agree not to:

  • Use the Service for illegal purposes
  • Upload malicious software or harmful code
  • Attempt unauthorized access to systems
  • Interfere with the operation of the Service
  • Reverse engineer or copy the software

Violation of these rules may result in account suspension or termination.


13. User Content

Users retain ownership of the data they upload or create using the Service, including invoices and client information.

By using the Service, you grant Quimbel a limited license to store, process, and display that content solely for the purpose of operating and improving the platform.

You are solely responsible for the accuracy and legality of your invoice data.


14. Intellectual Property

All rights, title, and interest in the Quimbel platform, including software, branding, design, and technology, remain the exclusive property of Quimbel.

These Terms do not grant users any ownership rights to the platform.


15. Service Availability

Quimbel aims to provide reliable service but does not guarantee uninterrupted availability.

The Service may experience interruptions due to:

  • Maintenance
  • Infrastructure failures
  • Software updates
  • External service disruptions

Quimbel is not responsible for damages caused by temporary outages.


16. Data Protection

Personal data is processed in accordance with the Quimbel Privacy Policy.

Users may request:

  • Access to their data
  • Data correction
  • Data deletion

17. Limitation of Liability

To the maximum extent permitted by law, Quimbel shall not be liable for:

  • Loss of profits
  • Loss of revenue
  • Loss of business opportunities
  • Loss of data
  • Indirect or consequential damages

In all cases, the total liability of Quimbel shall not exceed the amount paid by the user to Quimbel during the previous 12 months.


18. Indemnification

You agree to indemnify and hold harmless Quimbel, its affiliates, and employees from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Any unlawful or inaccurate invoice content created through the Service

19. Force Majeure

Quimbel shall not be liable for failure or delay in performing obligations due to events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Internet outages
  • Cyber attacks
  • Government actions
  • Infrastructure failures

20. Termination

Quimbel may suspend or terminate accounts if:

  • These Terms are violated
  • Fraudulent or abusive behavior is detected
  • Required by law or regulatory authorities

Users may terminate their accounts at any time.


21. Changes to These Terms

Quimbel may update these Terms periodically.

Updates will be posted on this page with a revised effective date.

Continued use of the Service after changes constitutes acceptance of the updated Terms.
